Prospective Marriage Visa (Subclass 300)

The Prospective Marriage 300 visa is designed for individuals engaged to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. This visa permits the holder to reside in Australia for up to nine months and apply for the Partner (subclass 820 and 801) visa during this time.

Advantages of the Prospective Marriage Visa

As a holder of the Prospective Marriage Visa (subclass 300), you are entitled to:

  • Stay or visit Australia during the validity of the visa
  • Work and study in Australia at your own expense
  • Leave and re-enter Australia multiple times

Note: New Zealand citizens should notify the immigration authorities if they hold a Prospective Marriage visa. Failure to do so may lead to the issuance of a subclass 444 visa, which can complicate future partner visa applications.

 

Eligibility Criteria

For Visa Applicants

  • You must be at least 18 years old
  • You must apply from outside Australia and remain outside when the visa is issued
  • You must meet the criteria for a committed relationship
  • Your partner must sponsor you
  • You must fulfill health and character standards
  • You must have no outstanding debts to the Australian Government, or arrangements must be in place to repay them

For Sponsors

  • You must be the fiancé(e) of the visa applicant
  • You must not have or have previously had certain visas

As a sponsor, your responsibilities include

  • Any outstanding debts to the Australian Government that your fiancé(e) may have
  • Ensuring your fiancé(e)’s adherence to their work obligations in Australia
  • Ensuring your fiancé(e) follows the terms of their visa

 

Family Members

You can include your dependent children or stepchildren in your application. Once granted, your family members will share your visa conditions and rights.
